Aliens Responsibilities at Various Stages of the Green Card Process


  Who worries about what?

The universities responsibilities in the permanent residency application process are to provide assistance in obtaining an approved I-140, the actual key to the “green card”. This petition, based on your UGA employment, is signed by the university. All other documents required for PR are considered your property and therefore your responsibility. The university requires that you keep your underlying H status valid until the I-140 has been approved. This provides a blanket of protection to keep working should something happen during the processing of your PR request.

  What do I need to give the ISSIS for my file?

It will be important that you keep the OIE-ISSIS Permanent Residency unit advised on the progress of your petition. It would be helpful if the primary applicant could submit copies of receipt notices for the I-485 as well as copies of the EAD card and Advanced Parole document if they have been requested.

  Do I need to do any special paperwork with my department?

YES! After your I-140 has been approved and you move from H status to one of pending permanent resident with an EAD card or permanent resident with the actual “green card”, you will need to complete a new I-9 form in your department. The documentation that shows you have permission to work in the US has changed, it is no longer the H approval notice and the ending date of employment is no longer the one shown on that form. It will also be important for the department to notify HR that you are now a pending permanent resident or permanent resident.

  Should I contact payroll about my new status?

YES! Because your new status may have an effect on the taxes you are required to pay and the benefits to which you are entitled. You should contact Susan Caldwell in the UGA payroll office to make sure all your university documents are in order. She will ask for the appropriate copies of your documents and will inform you of any forms you may have to complete.
