Obtaining TN Status
Now that you have decided that TN status is the appropriate one for your prospective
UGA employer. You must then decide which is the best way for the employee to obtain
the status. There are two ways that a Canadian (remember that Mexican nationals
should follow the H-1B procedures) can obtain TN status:
-
Enter the U.S. with appropriate paperwork in hand and gain TN status immediately
upon entry. Documents needed for this are:
- Proof of Canadian Citizenship
- Letter offering employment under the terms of TN program (an example of this can be obtained in the OIE, but the hiring department should write this letter).
- Educational credentials and licenses (if originals are not in English then credential evaluation should be done)
- Curriculum Vitae
Costs: Prospective TN workers who cross the border pay $50, plus
$6 for the I-94 card. Dependents pay only for the card(s).
-
File to change status to TN while already in the U.S. in another immigration status.
To do this a form I-129 must be filed by the OIE to USCIS. This process can take
several months and the prospective employee cannot begin work until we receive
approval from USCIS.
Costs: $185.00 for the primary TN and $195.00 for any dependents
Extensions
Once your employee has obtained TN status it is valid for one year,
but can be extended indefinitely. If the department wants the employee to continue
employment in TN status an extension will need to be filed. Please contact
the OIE to find out how to file an extension.
Dependents
Dependents of TN status holders can be in the U.S. in TD status.
People in TD status can attend school either part or full time but they are not
allowed to work while in the U.S.
